These Terms and Conditions govern all services provided by Line of Art Construction (“Company”, “we”, “us”), CSLB License No. 1085510 A, operating in the State of California. By requesting a proposal, signing a contract, or engaging our services, you agree to these terms.

1. Services

Line of Art Construction provides outdoor construction services including, but not limited to: pool and spa construction, outdoor kitchen and BBQ construction, fire pit and fireplace construction, hardscape and paver installation, landscape remodeling, retaining wall construction, block wall construction, deck construction, concrete flatwork, and patio construction in the Greater Los Angeles area.

2. Proposals and Contracts

All work is performed pursuant to a written contract signed by both parties. Proposals are valid for 30 days from the date of issue. Pricing is subject to change after 30 days due to material cost fluctuations. Work will not commence until a signed contract and required deposit are received.

3. Payment Terms

Payment schedules are established in each project contract. A deposit is required to initiate scheduling. Progress payments are due at milestones as defined in the contract. Final payment is due upon project completion and before final walkthrough. We accept check, ACH bank transfer, and major credit cards (3% processing fee applies to credit card payments).

California law (B&P Code §7159) limits the initial deposit for home improvement contracts to 10% of the total contract price or $1,000, whichever is less, for jobs over $500. Contracts will comply with applicable California law.

4. Change Orders

Any changes to the scope of work agreed to in the original contract must be documented in a written change order signed by both parties before the change is implemented. Changes may affect project cost and schedule. Verbal authorizations for additional work are not binding.

5. Permits

We will obtain all required building permits for work within our scope as specified in the contract. Permit fees are the responsibility of the Client and will be reflected in the project contract or a subsequent change order. Permit timelines are controlled by municipal agencies and are outside our control.

6. Warranty

Line of Art Construction warrants workmanship against defects for a period of one (1) year from the date of project completion. This warranty does not cover: (a) damage caused by Client or third-party alterations; (b) normal wear and tear; (c) damage caused by natural events, settling, or soil movement beyond our control; (d) materials under their manufacturer’s warranty, which we will assist in processing. Pools are subject to the warranty terms specified in the pool contract, which may differ from the above.

7. Limitation of Liability

Our liability for any claim arising out of or related to our services is limited to the total amount paid by the Client under the applicable contract. We are not liable for indirect, incidental, consequential, or punitive damages. This limitation applies to the fullest extent permitted by California law.

8. Client Responsibilities

The Client is responsible for: providing accurate property information and boundaries; ensuring site access during scheduled work hours; securing or removing personal property from the work area; and informing us of any underground utilities or structures not identified by DigAlert (811).

9. Subcontractors

We may use licensed subcontractors for specialty work (electrical, plumbing, gas). All subcontractors engaged by us are licensed and carry their own insurance. We remain the primary responsible party for quality and schedule.

10. Dispute Resolution

Any dispute arising from these terms or a related project contract shall first be subject to good-faith mediation. If mediation fails, disputes shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. The prevailing party may recover reasonable attorney’s fees.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of California. The Contractors’ State License Board (CSLB) regulates licensed contractors in California. Our license number is 1085510 A. You may verify our license status at cslb.ca.gov.
